Terms of Use

The agreement between you and Atypical Co. LLC for using Ping.

1. This agreement

These Terms are a contract between you and Atypical Co. LLC ("we", "us"). They govern your use of the Ping iPhone app and pingworld.co. By installing or using Ping you accept them. If you do not accept them, do not use Ping.

Our Privacy Policy forms part of this agreement.

This agreement is between you and us only. Apple is not a party to it. Apple has no responsibility for Ping or its content.

2. Who may use Ping

  • You must be at least [MINIMUM AGE — confirm 13 or 16] years old.
  • You must not be barred from using the app under the laws of your country or of the United States.
  • You must not be located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and you must not appear on any US Government list of prohibited or restricted parties.
  • You must comply with all applicable third-party terms, including your wireless carrier's.

Ping requires an iPhone 15 Pro or later running iOS 26 or later. Ping is licensed to you for personal, non-commercial use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.

3. Your identity lives on your device

Ping has no accounts. Your identity is a set of cryptographic keys generated on your iPhone, and your content is stored on your iPhone. This has consequences you should understand before you rely on the app:

  • We cannot recover anything for you. There is no password to reset and no account to restore, because we hold neither.
  • Without Memory, a lost or wiped iPhone means the content on it is gone, and your friends will need to add you again on a new device.
  • With Memory (section 6), what you authored can be restored to a new iPhone using a key held in your iCloud Keychain. That restore depends on your Apple Account and iCloud Keychain remaining available to you.
  • You are responsible for your device passcode, your Apple Account, and your device backups.

4. Your content

Everything you post in Ping is yours. We claim no ownership of it and acquire no licence to use, display, reproduce, or analyse it — and no such licence would help us, because your content is encrypted before it reaches us and we cannot read it.

You are responsible for what you post, and you confirm that you have the right to post it. When you share something with a friend, they receive a copy on their own device. You should assume that a copy you have shared cannot be unshared: retraction removes content from devices that are reachable, but a recipient may have saved, screenshotted, or copied it first.

5. Rules of use

Zero tolerance

There is no tolerance for objectionable content or abusive behaviour in Ping. Accounts and devices found to be posting such content will be removed from the service.

You must not use Ping to create, post, send, or store content that:

  • sexually exploits or endangers a child, in any form;
  • depicts, promotes, or incites violence, terrorism, or self-harm;
  • harasses, threatens, bullies, defames, or impersonates any person;
  • promotes discrimination or hatred against any group or individual;
  • is unlawful, infringes someone's intellectual property or privacy, or discloses another person's private information without their consent;
  • is intimate or sexual imagery of a person shared without their consent;
  • promotes illegal goods, fraud, or deceptive schemes.

You must also not attempt to interfere with, overload, reverse-engineer, or circumvent the security of Ping or our relay, use Ping to send unsolicited bulk messages, or use automated means to create identities.

6. Reporting, blocking, and what we do

Every post and every message in Ping has a Report action. Every person can be blocked from their profile. Blocking is immediate: they stop reaching you, and nothing further of theirs arrives.

We act on reports of objectionable content within 24 hours. Acting means removing the reported content from the service where we are able to, and removing the reported person's ability to reach the people who reported them. We may remove content and eject a device from the service without notice where we judge that necessary, including permanently and for a first offence.

Because we cannot read content, a report is how we learn of it: the reporting device supplies what is needed for us to act. Reports reach abuse@pingworld.co, which is monitored. You may also report by email without opening the app.

We cooperate with lawful requests from authorities to the extent we are able. What we are able to provide is limited by what we hold, which is described in the Privacy Policy: we cannot produce the content of anyone's posts or messages, because we cannot decrypt them.

7. Memory subscription

Ping is free. Every feature of the app, including delivery, is free for everyone, with no advertising. Memory is the one optional paid feature.

Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price for the plan you selected.

You can manage your subscription and turn off auto-renewal in your Apple Account settings after purchase. Deleting Ping does not cancel a subscription. Refunds are handled by Apple under the App Store Terms of Service; we cannot issue them.

If you cancel, extended retention ends and content held for you ages out on the standard 29-day schedule. Content already restored to your device is unaffected. If we change the price, we will tell you before it applies to you, and Apple will ask you to confirm.

8. Availability, and changes to Ping

We aim to keep Ping running and will not pretend it cannot break. Ping is provided on an "as is" and "as available" basis. Our relay may be unavailable for maintenance or for reasons outside our control; when it is, devices on the same network can still reach each other directly, and posts are delivered when connectivity returns.

We may change, add, or remove features. If we discontinue Ping, we will give reasonable notice through the app and this site so you can retrieve what matters to you. Content already on your device stays on your device.

We may update these Terms. If a change is material we will notify you in the app before it takes effect. Continuing to use Ping after that means you accept the new version.

9. Ending it

You can stop using Ping at any time by deleting the app. Doing so removes your identity keys and your content from that device.

We may suspend or end your access to our relay if you breach these Terms, particularly section 5. Because Ping is not account-based, this operates at the level of a device rather than a person.

10. Disclaimers and liability

To the fullest extent permitted by law, Ping is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Ping will be uninterrupted, error-free, or that content will always be delivered.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability to you is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100.

Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep your statutory rights.

You agree to indemnify us against claims arising from your content or your breach of these Terms.

11. Apple

These provisions are required for apps distributed through the App Store, and apply to your licence to use Ping on an Apple device:

  • This agreement is between you and us only, not with Apple. We — not Apple — are solely responsible for Ping and its content.
  • Apple has no obligation to provide any maintenance or support for Ping.
  • If Ping fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind with respect to Ping.
  • We, not Apple, are responsible for addressing any claim relating to Ping, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims.
  • We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party claim that Ping infringes intellectual property rights.
  • You must comply with the legal-compliance requirements in section 2.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce them against you.

12. Governing law

These Terms are governed by the laws of [GOVERNING LAW — state of formation, confirm before publication], without regard to conflict-of-laws rules. Courts located in [VENUE — confirm before publication] have exclusive jurisdiction, except that if you are a consumer resident in the UK, EU, or EEA, you may bring proceedings in your country of residence and the mandatory consumer protections of that country continue to apply to you.
